April 21, 2017

Sometimes, when couples separate, one spouse stays in the matrimonial home for years following the separation, even when they are not on the title to the house. While it’s not unusual for one spouse to hold the title to the house in their name as sole owner, if you are planning on living at the…

If you’re looking for a rough idea of how much you might be entitled to in spousal support (based on your respective incomes, and length of marriage), there’s a free online tool that can help. Many clients want to know how much a lawyer will cost. This depends on many factors, including the level of disagreement or animosity that exists between the parties and/or the lawyers. Other than the initial consultation and an uncontested divorce which are charged as flat fees, the cost of my services is based on an hourly rate of $250.00 per hour plus HST. I will not commence work on any file without a monetary retainer in trust and/or a payment plan. I always provide estimates for the amount of time I expect to work on a file so that you can decide ahead of time if it’s worth your while to pursue a certain course of action. When the retainer is exhausted, a new retainer will be requested.

Initial consultation

$175.00 plus HST

Uncontested divorce

$950.00 plus HST & disbursements

Unbundled services

Preparing for court session: $450.00 plus HST
Reviewing financial statements: $750.00 plus HST
Drafting court pleadings: hourly rate of $250.00 plus HST

The following are estimates only based on my hourly rate of $250.00/hour and do not include HST:

Separation Agreements

$3000.00-4500.00

Litigation

Preparing an Application or Answer: $1750.00-2500.00
Case Conference or Settlement Conference: $1250.00-1750.00
Substantive Motions $4,000.00-5500.00

For matters which do not settle after one or more interim motions, the costs of proceeding to a trial are extremely expensive. To give you an idea of approximate costs, the 2014 Canadian Lawyer Fees Survey found that the cost of a 5 day family trial ranged from $26,000.00- $59,000.00.
