Family Litigation During Covid-19

April 23, 2020

As most are aware, the family courts have been closed since the start of the pandemic in March, except for the most urgent cases, and some straightforward procedural issues. What falls within the ambit of what is considered urgent includes matters involving the “wellbeing being of a child, including essential medical decisions, or issues relating…

Using life insurance to secure support

June 7, 2017

It’s not uncommon for payors of support- whether it’s child support or spousal support- to have their support obligations secured by a life insurance policy. If the payor dies prematurely, the life insurance policy is available to satisfy the remaining balance of their support payments. A court can order that support be secured by way…

Prices for Services (Divorce, Consultation, Litigation & Separation Agreement)

Many clients want to know how much a lawyer will cost. This depends on many factors, including the level of disagreement or animosity that exists between the parties and/or the lawyers. Other than the initial consultation and an uncontested divorce which are charged as flat fees, the cost of my services is based on an hourly rate of $275.00 per hour plus HST. I will not commence work on any file without a monetary retainer in trust and/or a payment plan. I always provide estimates for the amount of time I expect to work on a file so that you can decide ahead of time if it’s worth your while to pursue a certain course of action. When the retainer is exhausted, a new retainer will be requested.

Initial consultation

$175.00 plus HST

Uncontested divorce

$950.00 plus HST & disbursements

Unbundled services

Preparing for court session: $450.00 plus HST
Reviewing financial statements: $750.00 plus HST
Drafting court pleadings: hourly rate of $250.00 plus HST

The following are estimates only based on my hourly rate of $250.00/hour and do not include HST:

Separation Agreements

Preparing an Application or Answer: $1,750.00-2,500.00
Case Conference or Settlement Conference: $1,250.00-1,750.00
Substantive Motions $4,000.00-5,500.00

For matters which do not settle after one or more interim motions, the costs of proceeding to a trial are extremely expensive. To give you an idea of approximate costs, the 2014 Canadian Lawyer Fees Survey found that the cost of a 5 day family trial ranged from $26,000.00- $59,000.00.
